How joint enterprise disproportionality impacts Black people

The doctrine of joint enterprise allows people to be charged with a crime – even if they didn’t physically carry it out. It’s meant to convict people who’ve assisted or encouraged the perpetrator.

But all too often, say researchers – charging decisions are "overzealous" and based on evidence that’s "weak, and in some cases virtually non-existent."

The controversial measure has long been criticised for its disproportionate use against young black men. New research shared exclusively with this programme exposes systemic issues with the way it’s used.
