The boy was sitting on his mother’s lap while her friend, Layota Ferrell, was driving.
The police say the car was being driven towards an officer. Neither his mother nor the driver have been charged with any crime.
The family’s lawyer is challenging the decision and demanding the release of body-camera footage.
