The main question for the justices is whether lower courts overstepped their authority by blocking that January 20 order on a nationwide basis. Justice Elena Kagan is getting to the heart of the practical questions about what would happen if the high court sides with Trump on the issue of nationwide injunctions. Solicitor General D. John Sauer tried to respond to Kagan by discussing the court\u2019s ability to quickly move to the merits and that challengers could potentially file a class action lawsuit.
